**User Agreement and Terms of Service**  

**INVESTMENT FUNDS ACCOUNT PTY LTD** (trading as **IFAInvest**)

**1. Introduction**  

These Terms of Service (“Agreement”) govern your access to and use of the website https://www.ifainvest.com/ , mobile applications (if any), and all related online banking, investment, loan, transfer, savings, and financial management services provided by **INVESTMENT FUNDS ACCOUNT PTY LTD** (“IFAInvest,” “we,” “us,” or “our”), a global financial technology company headquartered at Bundesallee 210, 10719 Berlin, Germany.  

By registering an account, depositing funds, applying for a loan, investing, or using any Service, you (“you” or “User”) agree to be bound by this Agreement, our Privacy Policy (when published), Cookie Policy (available at https://www.ifainvest.com/cookie-policy), and any other policies or notices posted on the Website. If you do not agree, do not use the Services.

We may update this Agreement at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or Website notice.

**2. Eligibility**  

You must be at least 18 years old (or the age of majority in your jurisdiction), legally capable of entering contracts, and not barred from financial services. Services may not be available in all countries due to regulatory restrictions. You are responsible for ensuring compliance with your local laws.

**3. Account Registration and Security**  

- Provide accurate, current information during registration (name, email, phone, address, ID documents for KYC/AML).  

- Maintain confidentiality of login credentials. Enable multi-factor authentication if offered.  

- Notify us immediately of unauthorized access at info@ifainvest.com.  

- We may suspend or terminate accounts for suspected fraud, AML violations, or breaches.

**4. Services Overview**  

IFAInvest provides:  

- Secure online banking (balance monitoring, bill payments, real-time tracking).  

- International and domestic transfers.  

- Savings and account management.  

- Professionally managed investment funds and solutions to grow wealth.  

- Flexible loans with competitive rates, quick approvals, customizable repayment, no hidden fees (subject to approval and separate loan agreements).  

All Services are provided “as is.” We do not guarantee uninterrupted access or specific returns.

**5. Deposits, Withdrawals, and Transactions**  

- Deposits via approved methods (bank transfer, etc.) are subject to verification and holds.  

- Withdrawals processed within 3–7 business days (longer for international).  

- **Premature Withdrawal Policy for Investment Funds** (critical term):  

  - Certain investment products are designed for long-term holding (e.g., 5-year maturity periods) to optimize returns and structure.  

  - Premature withdrawals requested **within the first month** of investment incur a **2% early withdrawal penalty fee** on the requested withdrawal amount.  

  - This fee applies per international installment withdrawal and covers administrative costs, opportunity losses, and early termination impacts.  

  - The 2% penalty **must be paid upfront** directly to IFAInvest (via bank transfer to our designated account) **before** the requested principal amount will be released or credited to your designated account.  

  - **Example:** For a requested withdrawal of 5,000,000 CFA, you must first pay 100,000 CFA as the upfront penalty. Upon confirmation of receipt, the full 5,000,000 CFA will be processed and transferred.  

  - The upfront fee is **non-refundable**. Failure to pay within 7 business days may result in cancellation of the request.  

  - After the first month, different early withdrawal terms may apply (refer to product-specific disclosures).  

**6. Loans**  

Loan applications are subject to credit assessment, KYC/AML checks, and approval. Terms (amount, interest rate, repayment schedule) are governed by a separate Loan Agreement. No hidden fees; transparent terms apply.

**7. Fees and Charges**  

- Transaction/international transfer fees may apply (details in account dashboard or upon request).  

- Currency conversion markups.  

- Premature withdrawal penalty as detailed in Section 5.  

- Late payment fees on loans (per loan agreement).  

- We reserve the right to update fees with notice.

**8. Risks and Disclaimers**  

- Investments involve risk of loss of principal. Past performance is not indicative of future results. No guarantees of returns.  

- Loans must be repaid; default may impact credit and lead to collections.  

- We are not liable for market losses, third-party delays, or force majeure. Services provided without warranties.

**9. Limitation of Liability**  

To the maximum extent permitted by law, our total liability shall not exceed the amount of fees paid by you in the 12 months prior or €1,000 (whichever is lower). We exclude indirect, consequential, or punitive damages.

**10. Termination**  

We may suspend/terminate access for violations, regulatory reasons, or inactivity. You may close your account after settling obligations.

**11. Governing Law and Disputes**  

This Agreement is governed by the laws of Germany. Disputes shall be resolved exclusively in the courts of Berlin, Germany, unless mandatory consumer protections apply.

**13. Miscellaneous**
